Legislation
The following are bills submitted to the Virginia General Assembly since 2003 and studies conducted for the legislature concerning charitable gaming. For more information on the General Assembly, visit the Legislative Information System website.
2009
- HB 1702 Provides that the percentage, determined by the Charitable Gaming Board, which an organization must use for charitable purposes, which is based on “net receipts” rather than on “gross receipts” generated from charitable gaming. (Patron – Cosgrove)
- HB 2025 Allows proceeds from charitable gaming to be used for those expenses relating to the acquisition, construction, maintenance, or repair of any interest in real or personal property involved in the operation of the organization and used for lawful religious, charitable, community, or education purposes. The bill also based the annual audit fee on net receipts and not gross receipts. (Patron-D. Marshall)
- HB 2053 Refers to exception of prohibited acts. Provides that where a qualified organization that (i) is exempt from taxation pursuant to 501© of the Internal Revenue Code and (ii) owns the building or other premises utilized in whole or in part for the purpose of conducting bingo games, such organization may conduct more frequent operations, of bingo games, not to exceed four calendar days in any calendar week. The bill also increases bingo prize amounts, allows nonmembers of an organization to operate bingo games provided they are under the direct supervision of a member, and limits to 50 the number of bingo games in a session. - HB 2331 Provides that raffle tickets may be sold by and that the proceeds of sale shall not be included in determining the gross receipts for a qualified organization. Currently this is limited to instant bingo, pull tabs and seal cards. (Patron-Athey)
- HB 2595 Raises the permit exemption threshold from $25,000 to $50,000 for volunteer fire departments or rescue squads or auxiliary units thereof. (Patron - Lewis)
- HB 2610 Requires the Division of Charitable Gaming to contract with the State Lottery Department to provide administrative and marketing support for a on-time raffle conducted by a qualified organization as defined in 18.2-340.16, the proceeds, after payment of expenses, prizes, and 20 percent to the Virginia Film Incentive, shall be paid to the qualified organization conducting the raffle. The bill sets out the requirements for the conduct of the raffle (Patron-O. Ware).
- SB 1121 Relates to the conduct of “fifty-fifty” raffles. (Patron-Colgan)
- SB 1420 Requires the Charitable Gaming to contract with the State Lottery Department to provide administrative and marketing support for a on-time raffle conducted by a qualified organization as defined in 18.2-340.16, the proceeds, after payment of expenses, prizes, and 20 percent to the Virginia Film Incentive, shall be paid to the qualified organization conducting the raffle. 2008
- HB 134 Requires qualified organizations to separately account for bingo cards and the sheets used for bingo jackpot games from bingo cards or sheets used for any other bingo games. Currently bingo cards and sheets used for bingo jackpot games must be sold separately. (Patron – Albo)
- HB 226 Provides that the percentage, determined by the Charitable Gaming Board, which an organization must use for charitable purposes, is based on net receipts of the organization and not its gross receipts from charitable gaming. (Patron – Cosgrove)
- HB 1280 Places the regulation of charitable gaming under the Board and Department of Agriculture and Consumer Services. (Patrons – Spruill, Abbitt & Armstrong)
- HJ 81 Requests the Governor to determine the most appropriate methods and timing for consolidating the Department of Charitable Gaming, the Virginia Racing Commission, and the State Lottery Department into a single department under the State Lottery Department. (Patron – Marshall)
- SB 199 Places the regulation of charitable gaming under the Board and Department of Agriculture and Consumer Services. (Patron – Puller)
- SB 696 Allows each stub or other detachable section of each ticket won through some other authorized charitable game conducted by the same organization holding the raffle to be included in the raffle drawing. (Patron- Colgan).
